Attorney Richard PolivyRichard Polivy’s practice is concentrated in Secured and Unsecured Financial Transactions, Business Organizations, Real Estate Construction, Acquisition, Leasing and Divestiture Matters and in the representation of Lenders and Secured Creditors in Bankruptcy, Workout and Business Failure and Restructuring Transactions. Select clients have included Wells Fargo Bank, NA, CIT Group/Business Credit, Inc., Textron Financial Corporation, Bank of America, Amerada Hess Corporation, TD Bank, NA, Webster Bank, Alvin and Company, Inc., Win Holdings International, Inc., Birken Manufacturing Company, The Connecticut Spring and Stamping Company, Aerospace Techniques, Inc. and Primary Care Physicians of Central Connecticut, PC. He has been admitted as an attorney since 1971 and in private practice for the past 32 years.

He received his Bachelor of Arts Degree in 1968 from Case Western Reserve University and his Juris Doctor Degree from Boston College Law School in 1971 when he was also admitted to the Connecticut Bar. He was subsequently admitted to the United States District Court in Connecticut in 1972, the United States Court of Appeals for the Second Circuit in 1973, the United States Supreme Court in 1975 and the United States District Courts for the Southern and Eastern Districts of New York in 2003 and the Commonwealth of Massachusetts State and Federal Courts and the Federal Court for the District of Vermont in 2004. He is currently a member of the Connecticut and American Bar Associations as well as the American College of Commercial Finance Counsel and the American College of Life Insurance Counsel. Mr. Polivy served as a member of the Executive Committee of the Association of Commercial Finance Attorneys and is a past president.

From 1976 through 1984 he served as General Counsel of Aetna Business Credit, Inc. (Aetna) and BarclaysAmerican Business Credit, Inc. (now known as Bank of America Business Credit, Inc.). He was one of the original 25 founding employees of Aetna and participated as a senior member of the group responsible for the acquisition by Barclays Bank of Aetna at a time when outstanding Aetna loans were in excess of One Billion Dollars (US).

Mr. Polivy has spoken about Commercial Loan Transactions, Connecticut Construction Lending and the Law as well as The Bankruptcy Reform Act for several organizations including Executive Enterprises, the American Bar Association and Professional Education Systems. His article, “The Use of Arbitration Clauses in Loan Agreements” was published in The Secured Lender.
